We inform our. customers that our portal is a B2B e-commerce and the purchases made do not enjoy the warranty provided by the Consumer Code for faults and defects, but only the warranty provided by Omz Srl for its customers one year from delivery.

THE REPORT OF THE DEFECT AND/OR DEFECT MUST BE COMMUNICATED BY EMAIL TO: SHOPONLINE@OMZSRL.IT WITHIN 8 DAYS FROM THE RECEIPT of the goods or from the discovery of the defect UNDER PENALTY OF INVALIDITY.

For the return of products that the buyer considers defective or non-compliant, Omz SRL reserves the right to ask for images of the product for which the warranty is requested, in order to analyze it. In case of acceptance of the buyer’s objection, OMZ SRL will send a communication with the possible return authorization and the instructions for the return with costs and risks to be borne by the buyer.

OMZ SRL will then repair or replace the product and ship it to the buyer within the necessary technical time. in any case, the buyer, before returning the product, must wait for the instructions or any proposals from OMZ SRL, under penalty of forfeiture of any right to the warranty.

• The right of withdrawal cannot be exercised by the buyer.

any other warranty, including by law, and any other provision provided for by the law in favour of the buyer shall be considered excluded and superseded by these conditions.

All contracts concluded online on the OMZ SRL website will be governed exclusively by Italian law, with the express exclusion of the discipline provided for by international conventions (Vienna Convention of 1980, etc., etc.) on the international sale of goods, and for any dispute the Court of Milan will have exclusive jurisdiction.

 

OMZ SRL reserves the right, at its sole discretion, not to accept requests for Registration or to suspend or prevent access to the site and to place orders, also by disabling the Identification Codes, of the Buyer who does not ensure sufficient guarantees of reliability or who has defaulted or who in any case wants to use the Site abusively or in bad faith tag. The Buyer agrees to apply to the transactions carried out through the use of the Identification Codes in any case attributable to its own activity and to the manifestations of will and/or consent expressed within the Site, the principle of imputable appearance, by virtue of which the Buyer will always and in any case be liable for the use, even abusive, of the Identification Codes attributable to him.

OMZ SRL may therefore legitimately consider the Buyer, identified by the Identification Code attributable to him, bound to all the aforementioned expressions of will and/or consent. The Buyer undertakes to take all necessary precautions to ensure the secrecy and correct use of the Identification Codes. The Buyer shall be solely responsible for any activity carried out through the use of the aforementioned Identification Codes.
